This notice provides additional privacy information for individuals who engage with the Public Protection Service (Environmental Health, Environmental Protection, Licensing [not taxi licensing] and Trading Standards).

Purpose(s)

We collect your personal information for the following purpose(s):

  • Carrying out statutory inspections of businesses;
  • Investigation of complaints or responding to enquiries;
  • Pro-active enforcement activities to ensure compliance;
  • For the prevention and / or detection of fraud and / or crime Intelligence sharing with enforcement partners;
  • To allow us to communicate with service users;
  • To fulfil a legal obligation;
  • To provide a chargeable service to businesses to drive compliance;
  • To signpost you to other sources of support.

Categories of Personal Data

In order to carry out these purposes we collect and obtain the following categories of personal data:

  • Name;
  • Address;
  • Contact details (email address, telephone number(s));
  • Full address of business premises (if applying to be an operator);
  • Type & size of business;
  • Names and addresses of other directors (if applying to be an operator);
  • Insurance details.

Special Category Data

We may also collect special category personal data that may include:

  • Racial or ethnic origin.

Legal Basis for Processing

We collect and use your personal information because:

  • You have given your consent under GDPR Article 6(1)(a).
  • It is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract under GDPR Article 6(1)(b);
  • It is necessary under GDPR Article 6(1)(e) for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council; or

If you fail to provide certain information when requested, we may not be able to provide the service to you or we may be prevented from complying with our legal obligations.

  • and, if relevant, personal data relating to criminal convictions and offences to perform our public task as required by law.

[Exceptionally, under GDPR Article 6(1)(d) information may also be shared if it is necessary to protect individuals from harm, or under GDPR 6(1)(d) because a serious crime has, or may be, committed. 

Where has your personal information come from?

Most of the information we hold is provided by you, this could be the details you provide when you complete a licensing application or food business registration or if you seek business compliance support from us. We also hold information from individuals raising an issue or making a complaint about a business.

We will only collect basic personal data about you which includes your name, address, telephone number, email etc. together with information you have given us and information that we receive from third parties, for example Citizens Advice, Department for Environment & Rural Affairs, Food Standards Agency, Health & Safety Executive, Greater Manchester Police, Greater Manchester Fire & Rescue Service, Department of Work and Pensions, Office for Product Safety & Standards, Greater Manchester local authorities and other Tameside Council departments.

Who will we share your information with?

We may collect and share personal information about you with the following types of organisations:

  • Other Tameside Metropolitan Borough Council Services;
  • Safeguarding agencies and partnerships;
  • Commissioned partners (e.g. a charity or other organisation that we ask to provide services on our behalf) and other voluntary and private sector organisations who assist in delivering our service);

  • Schools, education providers and specialist teachers;
  • Early education and childcare providers, such as nurseries and pre-schools;
  • Greater Manchester Police (and other Police forces where appropriate);

How long we will keep your data for and why?

We will only retain information for as long as it is necessary to provide services to you and/or for as long as required by us in order to comply with statutory retention periods.

Transferring data outside the European Economic Area (EEA)

Your information is not processed outside of the European Economic Area.

We use appropriate technical, organisational and administrative security measures to protect any information we hold in our records from loss, misuse, and unauthorised access, disclosure, alteration and destruction.
